Changes to Victoria’s Water Restriction By-laws

Westernport Water revokes Water Restriction By-law 105.

In accordance with section 287ZC of the Water Act 1989, Westernport Water hereby gives notice that it has made a by-law, titled ‘Water Restriction By-law 106’, pursuant to sections 171 and 160 of the Water Act 1989.

Water Restriction By-law 106 is made using a Model Water Restriction By-law issued by the Minister for Water on 4 March 2022. Water Restriction By-law 106 is made in relation to restrictions and prohibitions on the use of water that may be imposed in the Water Supply Districts of Westernport Water.\

Summary of changes

The new Model Water Restriction By-law is the same as the existing Water Restriction By-law, with two minor additions:

  • Encourage the use of alternative water sources (such as recycled water) for dust suppression under all stages of restriction where it is practical, safe and reasonable to do so. The existing By-law only encourages the use of alternative sources under stage 4 restrictions.
  • Require residential and commercial pool and spa owners under stage 4 restrictions to submit a Water Use Plan if topping them up with anything other than a bucket or watering can. The existing By-law only allows top ups using a bucket or watering can under stage 4 restrictions. The change will encourage pool and spa owners to consider water efficient practices, such as using a cover, to help conserve water during restrictions.

The purpose of the by-law is to:

  1. promote the efficient use and conservation of water
  2. set out four stages of restrictions on the use of water
  3. specify things which must not be done while each stage of restriction persists
  4. specify principles for considering applications for exemptions from particular restrictions
  5. prescribe offences and penalties for the contravention of the by-law, including for which an infringement notice may be served
  6. prescribe classes of persons for the purpose of issuing infringement notices.
